The terms that govern this site.

1. 1Who we arePaint of Society is operated by Apeka Group Limited, a company registered in England and Wales, company number 17105369, registered office 66 Paul Street, London EC2A 4NA, United Kingdom. Questions and complaints: hello@paintofsociety.com. These terms are the contract between you and us when you use the site. Pixel sales are currently closed.
2. 2What a pixel isA pixel is one square of the shared 1,000 x 1,000 canvas. A painted pixel and its optional message are displayed permanently as part of the collective artwork, together with a commemorative certificate for its owner. A pixel is a digital product. It is not an investment, a security, a share, or a financial product of any kind: pixel owners receive no money, no resale value, and no financial return, and should not expect any. Regions of the canvas are created by invited artists; invited artists and galleries take part under separate participation agreements, and where those agreements apply they prevail over these terms.
3. 3Sales and paymentPixel sales are closed and no payment is taken on this site. If sales open in the future, prices and payment terms will be published on this page before any purchase.
4. 4One design, locked foreverA pixel is painted once. Its design and message are locked and form a permanent part of the artwork. Pixels cannot be repainted, transferred, gifted, or resold, and accounts are personal.
5. 5Your licence to usYou keep the copyright in the design and message you submit. So that the shared artwork can exist, be displayed, promoted, and one day be sold as a whole, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable licence to host, store, reproduce, adapt (only as needed to display and reproduce it), publish, display, and communicate your contribution as part of the canvas and the finished artwork, to use it to promote Paint of Society, and to pass these rights on to any purchaser and any subsequent owner of the finished artwork. This licence survives the closure of your account.
6. 6Moral rightsTo the extent permitted by law (section 87 of the UK Copyright, Designs and Patents Act 1988), you unconditionally and irrevocably waive your moral rights in your contribution, including the right to be identified as its author and the right to object to how it is treated as part of the collective artwork. A million-pixel collective work cannot credit each contributor or seek approval for how contributions appear together.
7. 7Your promises about your contentYou promise that you created your design and message or hold all rights needed to grant the licence above, that your content does not infringe anyone's copyright, trademark, privacy, or other rights, and that it is not illegal. If we suffer loss because this promise is untrue, you agree to compensate us for reasonable, foreseeable losses caused by your breach. This does not apply where you acted with reasonable care, and nothing in this section limits your statutory rights as a consumer.
8. 8Content rulesYou must not submit content that is illegal in the UK or in your country, including content that promotes terrorism, sexually exploits or endangers children, is pornographic or sexually explicit, incites hatred or violence, harasses, threatens, or defames a person, promotes fraud or scams, or infringes someone else's intellectual property. We may screen designs before or after they appear and may refuse or remove any content that breaks these rules.
9. 9Reporting, removal, and appealsAnyone can report a design or message using the Report button on any pixel or by emailing hello@paintofsociety.com. We review every report and remove content that is illegal or breaks these terms. If your content is removed, the pixels remain on the canvas, but the design is cleared. If you think we made a mistake, whether by removing your content or by not acting on your report, write to hello@paintofsociety.com and we will review the decision again.
10. 10The exhibition saleWhen 100% of the canvas is complete, the finished collective artwork will be offered for sale at a set price at an art exhibition. There is no auction and no public offering: the sale is a private art-market transaction. Proceeds of the sale are shared with the participating artists and galleries under their participation agreements, and Paint of Society retains a commission as organiser. The canvas may never reach completion, and we cannot guarantee that a sale will take place or that any particular price will be achieved. Permanent display means for the lifetime of the project: if we ever had to end the service before the canvas is complete, we would give notice on the site and keep a public archive of the canvas for as long as reasonably practicable.
11. 11Your accountYou must be at least 18 to own pixels or take part in the artwork. Keep your login details safe; you are responsible for activity on your account. We may suspend or close accounts that break these terms or abuse the service. Closing an account does not remove painted pixels from the canvas; see the Privacy Policy for how we unlink your identity on request.
12. 12Our liabilityNothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under UK law, and nothing affects your statutory rights as a consumer, including the right to digital content that is as described and of satisfactory quality. Beyond that, we are not liable for losses that were not foreseeable to both of us when the contract was made, and our total liability to you is limited to the amount you paid us.
13. 13Changes, language, and lawWe may update these terms; updated versions are posted on this page with a new version date. These terms are written in English and translated for convenience; if a translation conflicts with the English text, the English text prevails. These terms are governed by the laws of England and Wales and disputes go to the courts of England and Wales; if you are a consumer, you also keep the mandatory protections and courts of the country where you live.
